1. Personal Data
Ronald Frankl and Valentin Neuser (frankl neuser LEGAL) collect, process and use your personal data in the context of their law firm operations only with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the GDPR. If you are an opponent of a client of frankl neuser LEGAL, your data will be used to the extent permitted by law. The applicable data protection and civil law provisions will always be complied with.
Only those personal data are collected which are necessary for the performance and processing of legal services or which you have voluntarily provided to frankl neuser LEGAL.
Personal data is all data that contains individual details about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of people and biometric data such as fingerprints. Sensitive data such as health data or data in connection with criminal proceedings may also be included.
2. Information and Deletion
As a client or generally as a data subject, you have the right to information about your stored personal data, its origin and recipients and the purpose of the data processing as well as a right to rectification, data transfer, objection, restriction of processing and blocking or erasure of incorrect or inadmissibly processed data at any time, subject to the lawyer's duty of confidentiality.
If there are any changes to your personal data, frankl neuser LEGAL requests that you inform us accordingly.
You have the right to withdraw your consent to the use of your personal data at any time. Your request for information, deletion, correction, objection and/or data transfer, in the latter case, provided that this does not cause a disproportionate effort, can be sent to the address of the attorneys Valentin Neuser and Ronald Frankl stated in art. 9 of this declaration.
If you are of the opinion that the processing of your personal data by frankl neuser LEGAL violates the applicable data protection law or that your data protection claims have been violated in any other way, you have the option of lodging a complaint with the competent supervisory authority. In Austria, the data protection authority is responsible for this.
3. Data Security
Your personal data is protected by taking appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, unlawful or accidental access, processing, loss, use and manipulation.
Notwithstanding our efforts to maintain an appropriately high standard of due diligence at all times, it cannot be ruled out that information which you disclose to frankl neuser LEGAL via the Internet may be viewed and used by other persons. Please note that frankl neuser LEGAL therefore accepts no liability whatsoever for the disclosure of information due to errors in data transmission not caused by frankl neuser LEGAL and/or unauthorized access by third parties (e.g. hacking of email accounts or telephones, interception of faxes).
4. Use of the Data
frankl neuser LEGAL will not process the data provided to it for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. Excluded from this is the use for statistical purposes, provided that the data provided has been anonymized.
5. Transmission of Data to Third Parties
To fulfill your order, it may also be necessary to forward your data to third parties (e.g. counterparties, substitutes, insurance companies, service providers that frankl neuser LEGAL uses and to whom frankl neuser LEGAL makes data available, etc.), courts or authorities. Your data will be forwarded exclusively on the basis of the GDPR, in particular to fulfill your order or on the basis of your prior consent.
Furthermore, frankl neuser LEGAL informs you that in the context of legal representation and support, you will also regularly receive factual and case-related information from third parties.
Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. However, frankl neuser LEGAL only transfers your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection, or frankl neuser LEGAL takes measures to ensure that all recipients have an adequate level of data protection, for which purpose frankl neuser LEGAL concludes standard contractual clauses as amended from time to time.
6. Disclosure of Data Breaches
frankl neuser LEGAL endeavors to ensure that data breaches are detected at an early stage and, if necessary, reported to you or the competent supervisory authority without delay, taking into account the respective data categories that are affected.
7. Retention of Data
frankl neuser LEGAL will not retain data for longer than is necessary to fulfill its contractual or legal obligations and to defend against any liability claims.
8. Server Log Files
In order to optimize the website of frankl neuser LEGAL in terms of system performance, user-friendliness and the provision of useful information about the services of frankl neuser LEGAL, the provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to frankl neuser LEGAL. This includes your internet protocol address (IP address), browser and language setting, operating system, referrer URL, your internet service provider and date/time.
This data is not merged with personal data sources. frankl neuser LEGAL reserves the right to check this data retrospectively if it becomes aware of specific indications of unlawful use.
